The High Court on Monday cleared the way for Sonargaon upazila chairman Azharul Islam Mannan to resume his duty.
For six months, a suspension order on Azharul was stayed by the court.
The pro-BNP chairman was suspended by the LGRD ministry on July 5 this year for the third time after he had charges framed against him at a Narayanganj court in a criminal case.
A rule was issued asking the government to explain in four weeks why suspension of Azharul should not be declared illegal.
The High court bench consisting of Justice Naima Haider and Justice Abu Taher Md Saifur Rahman came up with the order and rule after Azharul filed a writ petition, challenging the government order that suspended him from his office.
Following the order, currently he does not have any legal bar to be discharged of his duty as chairman of Sonargaon upazila of Narayanganj.
Earlier, Azharul was suspended twice as he was accused in two other criminal cases.
